Evaluation waitlists and Child Find

Families across Nye County have told us the same story: they asked the school to evaluate their child, and then nothing happened for months. That delay is not a scheduling problem. It is a legal one.

What is happening here

PDOP and Voices for All Abilities (VFAB) are taking joint administrative action with the Nevada Department of Education to stop unlawful evaluation delays. We are collecting timelines from families so the pattern can be documented, not just the individual cases.

What the law says

  • Informal waitlists are not allowed

    School districts cannot put evaluation requests on an informal waitlist. Once a parent asks in writing for an evaluation, the district has to respond and start the clock.

  • PTT forms and Prior Written Notice are required

    Withholding a Permission to Test (PTT) form, or failing to give Prior Written Notice when a request is refused, violates federal Child Find law.

  • A joint systemic complaint is being organized

    PDOP and Voices for All Abilities are preparing a joint systemic state complaint with the Nevada Department of Education to force immediate testing and to secure compensatory education for students who lost time.

What to gather before you start

Bring what you have. Missing pieces will not disqualify you, and we can help you request records from the district.

  • The date you first asked the school, in writing, for an evaluation, and a copy of that request if you have it.
  • Any reply from the school, including emails, letters, or notes from a meeting.
  • Any Permission to Test (PTT) form you were given, signed or unsigned, with the date.
  • Any Prior Written Notice you received, or a note that you never received one.
  • Dates of any meetings where the evaluation was discussed, and who was there.
  • Report cards, progress reports, or teacher notes showing the concerns you raised.
